Appeals & Cassation

Scope of service

The final scope is confirmed after reviewing the facts, documents, jurisdiction, and applicable deadlines.

Review the operative part and reasons of the judgment against the pleadings, recorded defenses, evidence, expert work, hearing minutes, and applicable substantive and procedural law.

Confirm the correct route of challenge, the client’s standing and interest, finality, value or subject-matter rules, filing court, service requirements, security or fee issues, and controlling deadline.

Distinguish an appeal that may reopen fact and law within its legal scope from cassation, which ordinarily addresses legal or procedural error rather than a fresh assessment of evidence.

Identify supportable grounds such as misapplication or misinterpretation of law, procedural nullity, defective reasoning, contradiction, failure to address a material defense, or lack of evidential basis.

Prepare a focused petition and supporting memorandum that links each ground to the challenged passage, the record, the governing rule, and the precise relief requested.

Manage filing, service, document certification, hearing follow-up, stays where legally available, and the procedural consequences of reversal, remand, or rejection.
